We are increasingly creating new campaign lines, brand lines and brand names for our clients. As we do so, we need to be confident that they’re available to use, then subsequently owned by us/ the client.
It’s the account lead who is responsible for this process. Once Neverland has an idea, it is the role of the account person to check on Google that no-one is using the line/name, also checking close variations. Once approved by the client an additional level of clearance is required.

The AdSlogans search report comprises three elements:
a) a basic trade mark check;
b) a search of the AdSlogans database of over half a million lines; and
c) an analyst’s online research.

A check will cost around £500 and take 24-48 hours. Please note, if it’s multi-market, it’ll cost more and could take longer (EU is 3 months).
The client should then approve the line/ name for use. At this point, there are two options – either the client will take responsibility to register the trademark, or we can do it. Bird&Bird would do this for us. In the UK it costs around £1,500 for a trademark registration and can take up to three months. The process is that the trademark office will review the case (about a month), then it gets posted for objection (two months) if no one objects, you get a nice certificate of ownership. The good news is that if you’ve run a search and it’s clear, then no one can object, so you can be confident that you can crack on and use it, even without a certificate of ownership.
